Notifiable activities within environmental health protection

Certain activities that may affect human health must be reported to the municipality before they start. Here you can find information about notification requirements, supervision and self-monitoring for environmental health activities in Finspång Municipality.

According to Chapter 9 of the Swedish Environmental Code (Miljöbalken) and the Ordinance on Environmentally Hazardous Activities and Health Protection (Förordning 1998:899 om miljöfarlig verksamhet och hälsoskydd), certain environmental health activities must be reported to the municipality. It is prohibited to operate or arrange the following without prior notification:

  • Activities where the public is offered professional hygienic treatment involving a risk of bloodborne infection through the use of scalpels, acupuncture needles, piercing tools or other similar cutting or piercing instruments.
  • Public swimming pools or facilities used by a large number of people.
  • Preschools, open preschools, after-school centres, open leisure activities, preschool classes, compulsory schools, upper secondary schools, special schools, Sami schools or international schools.

According to Section 10 of the regulations issued by the Swedish Radiation Safety Authority (Strålsäkerhetsmyndigheten) on solariums and artificial tanning facilities, anyone planning to operate a cosmetic solarium must report this to the municipality.

Examples of notifiable activities that offer hygienic treatments include tattooing, piercing, foot care, microneedling and acupuncture.

The notification requirement means that the activity must be reported. This includes both the premises and the activity carried out there. Mobile activities are therefore also subject to notification. If a notifiable activity moves to new premises, it must be reported again to the Building and Environment Unit (Bygg- och miljöenheten), as a new risk assessment is required. If several notifiable activities share the same premises, each activity must be reported separately.

Submit notification at least six weeks before starting

A notification must be submitted to the Environmental Unit (Miljöenheten) at least six weeks before the activity starts. A fee is charged according to the municipality’s tariff. If you start the activity before submitting a notification, you may have to pay an environmental sanction fee under Chapter 3, Section 3 of the Ordinance on Environmental Sanction Charges (Förordning 2012:259 om miljösanktionsavgifter).

Supervision

In Finspång Municipality, the Building and Environment Unit (Bygg- och miljöenheten) is responsible for supervising environmental health activities. Supervision is carried out to ensure that the Swedish Environmental Code (Miljöbalken) and related regulations are followed. Examples of activities subject to supervision include:

  • Schools and preschools
  • Hotels, hostels and campsites
  • Swimming and sports facilities
  • Solariums
  • Hair salons
  • Multi-family residential buildings
  • Care homes and group housing

The municipality has the right to charge a fee for supervision in accordance with Chapter 27, Section 1 of the Swedish Environmental Code (Miljöbalken). The fee is charged according to the municipality’s established tariff.

You are responsible for having sufficient knowledge

Under the Swedish Environmental Code (Miljöbalken), you are responsible for monitoring your own activities and acquiring the knowledge needed to protect human health and the environment. Notifiable activities are required to have a self-monitoring system in accordance with the self-monitoring ordinance (egenkontrollförordningen).
